The following as amended by any posted notice or oral announcements during the sale, constitutes Taraba Illustration Art, LLC's (TIA) and the Consignor's entire agreement with the purchaser relative to the property listed in this auction. Bidding on any item, by whatever means indicates acceptance of these terms and all other terms announced during the auction.

PREMIUM – The buyer's premium for this sale will be 10% of the final winning bid price.

MINIMUM BID -- All items are subject to a minimum bid, which is the minimum price agreed to by the consignor and TIA below which the lot will not be sold. In most cases, the minimum is below the estimated range, but in no case will it exceed the low estimate. Minimum bids are listed. TIA reserves the right to withdraw any lot at any time prior to the bidding deadline.

ESTIMATES -- TIA furnishes estimates of values expected to be realized. The estimates are educated assessments based upon previous sales and experience. The estimates are not to be read as definitive prices. Bidding will begin at the minimum bid.

BIDDING – TIA will record the winning bidder's name and paddle number upon the close of bidding. Bids must be submitted to TIA to arrive no later than the bidding deadline. Once the deadline arrives, the auction will remain open until no further raises are received on that session's lots for a period of fifteen minutes. All bids will be entered competitively. You may call to check on your bids at any time. If you wish to be contacted as your bids are surpassed, please check the “call back” box on the bidding form. TIA reserves the right to reject any bid not commensurate with the value of such lot. Employees of TIA are not prohibited from bidding. Please refer to the BID FORM for further details on bidding procedures.

TITLE – At the close of bidding, title to the offered lots will pass to the highest bidder, subject to fulfillment to the terms and conditions set forth herein. Such bidder thereupon (a) assumes full risk and responsibility for the lot, and (b) will pay the full purchase price or such part as TIA may require. No lot may be transferred from the winning bidder's paddle. Buyers will be charged a late charge of 1.5% per month on the total price if payment in full is not received by TIA in accordance with these Conditions of Sale.

REMOVAL OF PROPERTY – All property must be removed from the premises not later than fifteen (15) business days following the sale. The purchaser of any lot that remains on the premises after that time may incur a charge for storage and handling of $5/day for each lot.

PAYMENT TERMS – All items are to be paid by (a) Cash, (b) Cashier's check,  or (c) Personal check. TIA reserves the right to hold merchandise purchased by a personal check until the check has cleared the bank. (d) wire transfer or (e) PayPal. The purchaser agrees to pay TIA a handling charge of $30 for any check not honored by the drawee. The purchase price, applicable taxes and shipping are payable in U.S. funds only. All accounts must be fully settled within 10 business days.

TAX – Wyoming state sales tax is charged on any purchases that are picked up or delivered in Wyoming unless the purchaser, regardless of state or country has given TIA a valid  sales tax exemption number issued by the state of Wyoming.

BREACH OF OBLIGATIONS – If the purchaser breaches any of its obligations under these conditions of sale, including their obligation to pay in full the purchase price of all items for which they were the successful high bidder, TIA may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and (b) re-offering at auction any item for which the purchaser has failed to pay in full thus holding the purchaser liable for any deficiency plus all costs of sale. All sales are final.

PREVIEW AND INSPECTION – Pieces may be viewed at TIA's offices by appointment up until the day before the bidding deadline.

SHIPPING – TIA is not responsible for the acts or omissions of shippers of purchased lots, whether or not recommended by us. Shipping of purchased lots is entirely at the risk and expense of the purchaser. At the choice of the winning bidder, packing and domestic shipping will be provided by TIA. The cost of TIA shipping is listed on winning invoices. If prevented by fire, theft or any other reason from delivering any property to the purchaser, TIA shall not be liable for any amount in excess of that actually paid by the purchaser. Any and all of these conditions may be waived or modified at the sole discretion of  TIA. Please allow one week for delivery once full payment has cleared to TIA's account.

DESCRIPTIONS OF WORKS 
Names of works, whether casual or conventional, are shown with initial caps. Actual captions are shown in italic within double quotes (“”); names of publications are shown in bold italic; names of advertisers or commissioning parties are shown in bold. Lack of any listed publication information does not indicate that the work was not published, only that TIA did not have that information at the time of listing. Medium is determined by visual assessment only and not by chemical analysis. As such it is not guaranteed. Size is given in decimal inches to the nearest .25”; height precedes width. All measurements are of image area only, not of support or frame.

CONDITION – All property is sold As Is and neither TIA nor the consignor makes any express or implied warranty or representation as to the condition of any lot offered for sale, and no statement made at any time, whether oral or written shall constitute such a warranty or representation. Descriptions of condition are not warranties. If you have questions on the condition of a work, please refer them to TIA. Notwithstanding any verbal or written condition report, all works and their frames, mounts, etc., if any, are sold as viewed on the day of the sale. Accordingly and ideally, all lots ought to be viewed personally by prospective buyers to evaluate the condition of items offered. Since personal viewing is not practical for everyone, TIA has endeavored to address any potential condition concerns as fully and accurately as possible as part of the description. TIA and the consignor make no representations or warranties, express or implied, that the purchaser acquires any copyrights or reproduction rights in the property.

Signed, initialed and monogrammed- Signatures, which in TIA's best judgment, are in the hand of the artist are listed with location.

GUARANTEE – TIA guarantees the authenticity of authorship of each lot as offered, with the exceptions listed below. Authorship is defined as the name of the artist as listed on the top line of the listing.
Name – In TIA's best judgment, the work is by the artist named.
Name (attributed to) – The artist named is TIA's best reasonable conclusion; TIA does not guarantee the Authorship of such a designated work.
Name (studio of) In TIA's judgment, the work was executed by an assistant of the artist named.

“Artist Unidentified” - TIA makes no guarantee as to the Author of such a designated work.

OWNERSHIP – TIA will hold in confidence the identity of all sellers of lots. Any lot in which TIA has an ownership interest will be marked with a Delta

PRICES REALIZED – A list of prices realized will be posted on the TIA website shortly after the sale. Any lots which are withdrawn from the sale or which fail to meet reserve will be so indicated on the listing.
